Legionella Risk Assessments – Rental Properties

Under current Health & Safety Law, if you rent out a property you have a legal responsibility to ensure you conduct your undertaking in such a way that your tenant(s) are not exposed to health & safety risks. COSHH provides a framework of actions to control the risk from a range of hazardous substances, including Legionella – to identify and assess the risk, and implement any necessary measures control and monitor the risk. Since the L8 Approved Code of Practice there has been a requirement for all landlords of domestic premises to assess the risks from exposure to Legionella to their tenants. HSE & local authority inspectors do not proactively inspect domestic premises or ask for evidence that landlords have undertaken a risk assessment.  However, if a tenant were to contract Legionnaires disease from the water system in their home, the landlord may be liable to prosecution under HSWA and would have to demonstrate to a court that they had fulfilled their legal duty. Landlords can be fined up to £20,000 and / or a custodial sentence for non-compliance.

What does the Legionella Risk Assessment include? 

Elite are fully trained and accredited Legionella risk assessors and our service ensures all your legal obligations are met. We conduct a full assessment of risk with the report highlighting any improvements required to reduce the risk and a full summary of control measures to implement. The report also includes a schematic drawing of the water system and a certificate which can be displayed in your rental property. We also ensure your tenants are aware of the risks of Legionnaires disease and their responsibilities and provide you and the tenant with a written information sheet for future reference. Each report is lodged with our accreditation body and individually insured. Lodgement fees and insurance, plus mileage within a 40 mile radius of Lockerbie is all included in our price of £50.00. Properties with Combi-Boilers still require a risk assessment! There are many different risk factors in a domestic setting even in properties with no water tanks.
